Terms of Trade

If you purchase any products via this website, you must agree to Bindle’s Terms of Trade (see Shipping).

Purchase and Sale of Alcohol

All alcoholic products offered for sale by Bindle are NOT available to persons under the age of 18 years. Under Victorian Legislation gifts containing alcohol can only be purchased by someone other than the ultimate receiver and both the purchaser and the ultimate receiver need to be over 18 years of age. 

Bindle supports the Responsible Service of Alcohol. 

1. Under the Liquor Control Reform Act 1998 it is an offence for a licensee to supply liquor to a person under the age of 18 years. It is an offence for a person under the age of 18 years to purchase or receive liquor from another person. 

2. Alcohol quantities are limited to 1.5 litres per recipient. When placing orders customers should ensure that they do not exceed sending the permitted alcohol limit of 1.5 litres (approximately two bottles) per recipient. 

3. Purchaser Representation: By ticking the ‘I agree’ button during the checkout process, the purchaser represents that they and the recipient, are over 18 years old. The purchaser accepts that it is an offence to falsely represent they are of legal age to purchase alcohol and to obtain alcohol on behalf of a person who is under 18 years. 

4. Delivery: Upon delivery of Bindle products, the recipient may be required to provide a valid ID for proof of age and sign for the goods.

Privacy

Personal information provided to Bindle via this website will be handled in accordance with Bindle’s Privacy Policy.

Security

Bindle’s credit card transactions are fulfilled by a banking institution authorised under the laws applicable to this website. When collecting credit card information for online purchases, Bindle offers secured server transactions that encrypt your information in transit to prevent others from accessing it. All information is stored on a secure server. Your credit card details are encrypted and then removed from our system once your order has been dispatched.

Although Bindle engages all reasonable efforts to safeguard the security of your information, transmissions made on or through the internet cannot be guaranteed to be entirely secure. Please contact your financial institution immediately if you become aware of unauthorised use of your account.

You will need to register to use certain parts of this website. When registering, you will be required to nominate a username and password. You must keep this username and password safe and must not disclose this information to any third party. If you become aware of unauthorised use of your account, please notify us immediately.

Shipping and Shopping

The information contained within this document relates to the Bindle online store, trading under Bindle.

Please read these Terms of Trade carefully as they contain important information including warranty disclaimers and limitations of liability.

Definitions and Application

1. In these Terms of Trade, "Bindle" means Bindle Retail (ABN 30 715 665 939) trading as Bindle, 'you' means the organisation or individual who is ordering product on the website, and the "Products" means the Bindle products which may be ordered on the website.

2. These Terms of Trade apply to any purchase of any Products by you from this website which are delivered in Australia.

Shipping Rates

For all orders delivered to an Australian address, we guarantee your Bindle gift will be sent same business day when ordered before 2pm

Bindle offers the following shipping options:

Standard: $10.00 (via Australia Post) - between 1- 5 business days for the Bindle to arrive.

Express Post: $16.95 (via Australia Post) – If order is placed before 2pm we guarantee next business day delivery if address falls within the Australia Post Express Post network

Same Day Melbourne Delivery (METRO MELBOURNE ONLY): $20 (via Courier) - If order is placed before 2pm we guarantee your Bindle will be delivered the same day to Metropolitan Melbourne Suburbs within 20km radius of Melbourne CBD

Free Postage where the online order subtotal is $300 or greater

Please note: Orders returned to Bindle due to incorrect address, failure to collect from Australia Post Outlet, or failure to contact courier after delivery attempt, will incur a re-shipping and re-delivery fee.

International Shipping

We're very happy to send orders internationally. However, due to the perishable and fragile nature of some of our gifts we'll need you to send us an email so that we can make sure we can get safely to its destination and quote you with a shipping rate. 

Our Delivery Promise To You

We pride ourselves on our ability to deliver Bindle gifts quickly and efficiently. We always endeavour to deliver your Bindle gift as close to your preferred delivery as possible. If your order is not delivered on your preferred delivery date, we are unable to cancel your order or credit your transaction.

Where the order is to be delivered to an Australian address, Bindle will:

Use reasonable endeavours to deliver the order within five working days (Monday – Friday,  excluding official public holidays) from the date the order was submitted by you; Australia Post delivery time varies depending on your location within Australia. You (the purchaser) will receive an Australia Post tracking advice number, please use this number to track your parcels movements via the Australia Post website http://auspost.com.au/track/.

When express post is selected, and Bindle gift is ordered before 2pm, Bindle will use reasonable endeavours to distribute the order same business day*, for delivery following business day within Australia Post guaranteed next day delivery network.

* Next business day delivery to remote areas and roadside delivery addresses is not guaranteed. For complete network details: http://auspost.com.au/parcels-mail/delivery-areas.html

If you are not home to receive your package then you need to pick it up from your nearest Australia post outlet.

Please note: If premises unattended a card will be placed in the post box and the parcel will be transported to the nearest Australia Post Outlet. 

Due to the hand-made and seasonal nature of many of the products sold on the Bindle website there is a possibility that availability may vary. In the event of a product being unavailable the website will specify this in the ‘quantity’ field.

Prices & Payment

All prices on the website are in Australian dollars. Prices are subject to change without notice.

The amount payable to Bindle for an Order (Order Amount) will be the total of the following amounts:

a. the sum of the price of each Product ordered as indicated on the website at the time of submitting the Order (Product Subtotal);

b. the cost of delivery determined in accordance with Delivery stated above, and

You must pay the Order Amount by credit card at the time of submitting the Order. Bindle accepts Visa, Mastercard, or American Express.

c. While we shall endeavour to keep pricing current at all times, pricing may be subject to change without notice

Bindles & Wrapping

All Bindles will be packed into a recycled cardboard gift box and wrapped with Bindle signature wrapping paper and tag.

The void filler is 100% recycled paper, but very fragile items will be wrapped in additional wrap. 

A note for the recipient will be printed on a sustainable gift card, so required details must be written in the note box on the checkout page.

Please dispose of the packaging thoughtfully.

Returns policy

In the event of products being damaged in delivery you can return the items. All products are checked for quality before dispatch and while we try our best to ensure that the product is delivered to you in perfect condition, the product may be damaged in the delivery process. Should this happen you can return the damaged items and we will re-send the product and pay for the return and additional postage charges. In the case where the product is sold out we will offer a full refund.

To arrange a return, seek a refund, replacement or exchange, you must email us on info@bindle.com.au to obtain prior approval. Please include the order number and reason for the return. Bindle shall bear the costs of all domestic return shipping.

Orders

1. To submit an order for Products (Order), you must:

a. complete and submit the online order through the Bindle Shopping Cart process.

2. Bindle reserves the right to refuse any Order. In such case, Bindle will notify you as soon as reasonably practicable and refund to you any payment in full.

3. All products ordered are for personal use and gifting only. They must not be resold in any form or any place; Bindle reserves the right to take legal action against unauthorised and unofficial sale of goods.

Liability 

1. Without limiting Bindle's legal rights arising from any failure by you to make a payment in accordance with these Terms of Trade, Bindle reserves the right, in its absolute discretion, to take any of the following actions against you if you fail to make such a payment:

a. withhold supply and dispose of the Products requested in the Order, and/or

b. refuse to deal further with you, and Bindle will not be liable to you for any loss or damage directly or indirectly resulting from any such action.

2. Subject to clauses 8.2 and 8.3 and to the fullest extent permitted by law, the Products are sold and information is rendered to you on the understanding that you have sole responsibility for determining the suitability of the Products for the purposes for which you intend to use them.

3. Subject to the following "No Warranty" clauses and to the fullest extent permitted by law, the liability of Bindle for any loss or damage suffered by you as a result of Bindle breaching its obligations under these Terms of Trade or other tortious duty (including arising by reason of defects in the Products) is limited to a refund or replacement of the relevant Products.

No Warranty

1. Subject to the following clauses and to the fullest extent permitted by law, Bindle gives no warranty in respect of the Products.

2. For consumers the Products come with non-excludable warranties and guarantees under consumer protection legislation, such as that Bindle is the rightful owner, the Products are reasonably fit for their usual purpose, are of acceptable quality, and match any description or sample. If Bindle breaches any of these non-excludable warranties or guarantees, you are entitled, at your option, to a refund or replacement of the relevant Products, and to compensation for any reasonable foreseeable loss.

3. You may also have express rights of action against Bindle under consumer protection legislation if Bindle supplied defective Products to you that cause you injury, loss or damage.

Refunds and Returns

Can I return full size items?

If you are not 100% satisfied with your full-size product purchase, you can return your un-opened, unused full-size product(s) in its original condition to Bindle within 14 days of the date on the invoice for a full refund upon pre-approval from Bindle. Bindle will not refund any opened, used, discounted, clearance or sales products.

My items was damaged in delivery, can I return it?

Yes you can return damaged items. All products are checked for quality before dispatch and while we try our best to ensure that the product is delivered to you in perfect condition, the product may be damaged in the delivery process. Should this happen you can return the damaged items and we will re-send the product and pay for the return and additional postage charges. In the case where the product is sold out we will offer a full refund.

Who do I contact to arrange a return?

If you intend to seek a refund, replacement or exchange, you must email us on info@bindle.com.au to obtain prior approval. Please include the order number and reason for the return. Bindle shall bear the costs of all domestic return shipping.

GST

1. Bindle is registered for GST (Goods and Services Tax)

General

1. If any provision of these terms is found by a court of competent jurisdiction to be invalid, such term shall be severed and the remaining terms shall be unaffected (in this instance the parties shall use reasonable endeavours to negotiate a suitable substitute provision).

2. Subject to clauses 8.2 and 8.3 and to the fullest extent permitted by law, these Terms of Trade together with the Order (as accepted by Bindle), the Legal Notice on the website and Bindle's Privacy Policy constitute the whole agreement between the parties and supersede all prior discussions and agreements between them.

3. Orders and these Terms of Trade will be governed by the law applying in the State of Victoria, Australia, and the parties irrevocably submit to the non-exclusive jurisdiction of the courts of Victoria, and the courts complement to determine appeals from those courts, with respect to any proceedings that may be brought at any time in relation to these Terms of Trade.
